The ALI-ELI Principles for a Data Economy presented at ERA webinar on ‘Digital Contracts and Data-Trading’

On 28 April 2022, Christiane Wendehorst presented the ALI-ELI Principles for a Data Economy at a webinar organised by the Academy of European Law (ERA).

On 28 and 29 April 2022 Academy of European Law (ERA) held an online workshop on the topic ‘Digital Contracts and Data-Trading’. The objective of the webinar was to discuss the impact of digitalisation on private law and, in particular, to discuss the recent Data Act Proposal by the European Commission together with experts in the field of data law, legal practitioners, stakeholders and representatives from public institutions as well as interest groups. The presentations and discussions revolved around topics like data access rights, data contracts, the impact of Artificial Intelligence on contract law and data as counter-performance.

ELI Project Reporter Christiane Wendehorst was invited to speak on the second Panel of the ERA Conference, which was dedicated to ‘Access to data and use of data’. In her speech titled ‘Data in private law and the requirements of the data economy’, Christiane Wendehorst presented the ALI-ELI Principles for a Data Economy and demonstrated how the main concepts of the ALI-ELI Principles have impacted international developments, such as the recent Data Act Proposal by the European Commission, or recent work by the United Nations Commission On International Trade Law (UNCITRAL) in the field of data transactions. Her fellow panelist Malte Beyer-Katzenberger from the European Commission (DG CNCT) also highlighted in his speech the major influence the ALI-ELI Principles had on the drafting process of the recent Data Act Proposal. Parts of the ALI-ELI Principles project team also submitted a response to the public consultation on the Data Act in fall 2021.
