Christiane Wendehorst's draft of a data protection regulation for AI, which she presented at the end of 2024, is beginning to bear fruit. One of the key demands of the draft, an extensive exemption from the scope of the GDPR for non-commercial activities, SMEs and low-risk data processing, has now been included in the coalition agreement between the CDU/CSU and SPD. The coalition wants this provision to be implemented at the European level. The coalition partners also say that the design of data protection must enable future advances in digitalisation and innovation. Explicit proposals for such an exemption provision and more innovation-friendly regulation can be found in the draft for an AI data protection regulation and can be accessed here: AI Data Protection Regulation.
