Conference: Digital Assets and Private International Law

On 11 April 2024, Christiane Wendehorst gave a presentation on the topic of "Proprietary Interests in Digital Assets and the Conflict of Laws".

Digital assets, such as cryptocurrencies, stablecoins and other tokens, have become important as investment and trading objects. This conference explored not only whether the methodology of private international law can be successfully applied to digital assets, but also whether it needs to be changed in light of the ‘blockchain revolution’.

When it comes to private international law, Wendehorst has especially dealt with international property law. She has commented on the relevant articles of the EGBGB in the "Münchener Kommentar zum Bürgerlichen Gesetzbuch".

As one of the contributors to the book "Blockchain and Private International Law", Wendehorst has already analysed the proposed solutions for determining the applicable law in the context of crypto assets.

"Any solution will normally end up with a waterfall of connecting factors, so the pivotal point is what should be at the top and at the bottom of the waterfall."

This conference organised by Prof. Matthias Lehmann dealt with this and many other topics related to digital assets and invited national and international experts.
