Abstract:
The Article 11 e-Privacy opinion document is a third-party funded project. The legal opinion provides a detailed analysis of the Art 11 of the proposed Regulation on Privacy and Electronic Communications (ePR) including the wording and legal principles contained therein. This opinion also examines the connections and relationships between the ePR and analogous pieces of EU legislation, in particular the Regulation 679/2016/EU (GDPR) and the Directive 680/2016/EU (Law Enforcement Directive or LED). Further, special attention was given to the issue of data retention, as well as the overall compliance of this Regulation with EU fundamental laws. The necessary connection of fundamental rights and their corresponding limitations were also examined in accordance with the intentions of legislative bodies.
