Mutual Assistance in the Digital Age
Funding body: European Commission
The MAiDA project (Mutual Assistance in the Digital Age) examines the effectiveness of the new European legal framework on mutual legal assistance (MLA) in criminal proceedings that require the exchange of electronic evidence (e-evidence). MAiDA focuses on legal and data protection challenges, in particular the role of private service providers and their compliance with European data protection rules. Specifically, the project aims to close certain gaps in legal research that become apparent when looking at the Second Additional Protocol to the Convention on Cybercrime and the e-evidence legislative package. MAiDA concentrates on the expected consequences of increased public-private cooperation in the field of mutual legal assistance in criminal matters. The aim is to develop doctrinal legal opinions on the interpretation of the new rules, policy recommendations and guidelines for best-practice procedures, for both the judiciary and private actors, regarding cross-border cooperation that safeguards fundamental rights, and to collect useful empirical data in this area.
