The definition of „AI system” under the new AI-Act

Christiane Wendehorst, together with the AI expert Bernhard Nessler has written an article on the new AI-Act for the MMR – Zeitschrift für IT-Recht und Recht der Digitalisierung entitled „Der Begriff des ,KI-Systems‘ unter der neuen KI-VO” (“The concept of ‘AI-system‘ under the new AI-Act”).

The definition of an ‘AI system’ in Art. 3 No. 1 AI Act has a key function for the entire AI Act. However, the chosen definition contains numerous ambiguities, which is why it is almost impossible to make a meaningful distinction from similar systems. This article proposes a "three-factor approach" to eliminate legal and technical inconsistencies from an interdisciplinary perspective.
