Legal questions on operating drones

Professor Iris Eisenberger held a talk at the Wiener Juristische Gesellschaft on March 22, 2023.

More than 100.000 drones are allegedly operated in Austria, but only a small number of them is operated in compliance with existing regulation. Almost nobody knows that drones are distinguished in different categories that lead to specific legal requirements for operating them. Since 2021 there are new regulations under Union law- They introduced limitations on weight, distance and height regulations, as well as area-specific regulations. Some drones even require a licence and liability insurance. Meanwhile others are classified as toys and are subjected to almost no regulation.

Professor Iris Eisenberger is co-author of the book “Drones and the Law”. In her talk, she analysed the current legal framework on drones. She answered, among others, the following questions: When can drones by flown over cities? Which requirements must be met to enable the inspection of infrastructure with drones? Could drones transport persons and dangerous goods? Can drones licenced in Austria also be operated in non-EU countries? When is a drone classified as a toy and which regulations apply?
