Christiane Wendehorst, Co-Lead of the GPAI project From Co-Generated Data to Generative AI – New Rights and Governance Models in Digital Ecosystems (Cogen 2024: Copyright and Data Protection Rights in Co-Generated Input and Output of Generative AI.docx), introduced the presentation together with Kyoko Yoshinaga. The principles, developed by Alain Strowel and Sebastian Schwamberger, provide an initial guidance for legislators worldwide who are addressing new copyright and data protection issues related to co-generated data and generative AI. They partly build on the ALI-ELI_Principles_for_a_Data_Economy.pdf, which Wendehorst co-authored with Neil Cohen.
Following the introductions by Wendehorst and Yoshinaga, thought-provoking reflections were shared by experts from academia and practice, including representatives from WIPO, the Open Data Institute, and the University of Pennsylvania. The discussions focused particularly on the intersections between data protection and copyright, challenges such as AI models “remembering” training data, and societal aspects, including crowdsourcing and data labeling.
