Wendehorst was able to contribute her expertise on this topic, drawing on her work as a member of the Expert Group on B2B Data Sharing and Cloud Computing Contracts of the European Commission.
The new EU Data Act has significant implications for many businesses, requiring manufacturers and service providers to share data from connected products and related services with users and third parties. Contracts are central to the Data Act, making it essential for legal advisors to guide clients on data access and to draft and negotiate data-sharing agreements. The ERA conference addressed the practical impacts of the Data Act, both before and after it becomes effective in September 2025.
The event focused on key topics including the new EU Data Act, model contractual terms for data sharing, smart contracts and cloud contracts, the Data Act and third countries, and the practice of data sharing.
