As a joint project between ALI and ELI, the Principles for a Data Economy focus on data transactions and data rights in the data economy. The principles have developed an innovative concept for rights to co-generated data, as well as regulations for data transactions and protection within data value chains. They have influenced legislation and the development of software worldwide. For example, the EU Data Act has adapted and adopted their concepts, and the UNCITRAL Working Group IV builds its work on data contracts on these Principles.
Recently, Christiane Wendehorst has also addressed this topic in her role as co-leader of the GPAI project “From co-generated data to generative AI: New rights and governance models in digital ecosystems (Co-Gen”). This project aims to help define the boundaries and range of appropriate individual and collective rights for co-generated data, content and AI systems, facilitating cross-border harmonisation and removing potential barriers to innovation.
