The sessions focused on discussing and revising the draft on default rules for data provision contracts, which was first developed at the 65th session of UNCITRAL Working Group IV (E-Commerce) in New York in April 2023. The default rules are intended to promote the creation of harmonized rules on data provisions and facilitate an enabling environment for cross-border data traffic.
As an expert dealing with this topic as part of her collaboration with the ALI and ELI, in her role as a member of an expert group for the European Commission as well as in her own research, Professor Wendehorst actively contributed to the discussions. The UNCITRAL work on this topic heavily builds on the ALI-ELI_Principles_for_a_Data_Economy_Final_Council_Draft.pdf, developed by Christiane Wendehorst and Neil B. Cohen.
