"Rethinking Copyright in the Context of Text and Data Mining"

Christoph’s thesis explores the impact of text and data mining technology on the system of copyright law, focusing on the challenges that the use of copyright protected subject matter as training data for generative AI models poses to the fundamental principles of copyright law. His work features two parts: Firstly it deals with the situation de lege lata, examining the current legal framework pertaining to the use of copyright protected subject matter as training data for generative AI models, focusing on legal questions of the application of existing exceptions and remedies of rightsholders. Secondly it examines structural changes that will be necessary for copyright law in order to deal with the technological changes, focusing on an analysis of copyright as an instrument of democratic expression as well as an analysis from an economic perspective.
